END USER LICENSE AGREEMENT (EULA) — HagoLaser

IMPORTANT: READ CAREFULLY BEFORE USE. By installing, activating or using HagoLaser (the "Software") you agree to be bound by this agreement. If you do not agree, do not use the Software and uninstall it.

1. SUBJECT AND LICENSE
The Software controls laser marking/cutting equipment with a compatible controller board. You are granted a limited, revocable, non-exclusive, non-transferable license to use it on the machine where it was activated. The free license lasts 1 year (renewable at no cost). The "3D Relief" module requires a separate paid license. Reselling, sublicensing, decompiling or circumventing the licensing system is prohibited, except as mandatorily permitted by law (e.g. interoperability, art. 6 Directive 2009/24/EC).

2. BETA SOFTWARE
The Software is in BETA: it may contain bugs, unexpected behaviour or interruptions. You accept this and agree NOT to use it in environments where a failure could cause damage you are not prepared to bear.

3. LASER SAFETY — USER'S RESPONSIBILITY
Fiber lasers are CLASS 4 devices: they can cause blindness, severe burns and fires within milliseconds. YOU are solely responsible for:
  a) ALWAYS wearing protective eyewear rated for the laser's wavelength;
  b) NEVER leaving the machine marking unattended;
  c) keeping the machine's physical safety systems operational (enclosure, door interlock, emergency stop, fume extraction);
  d) verifying parameters (power, passes, focus) before every job;
  e) complying with local laser-safety and occupational-safety regulations.
The Software may include convenience features (e.g. door warning) which do NOT replace the machine's physical safety systems.

4. NO WARRANTIES ("AS IS")
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, express or implied, including without limitation merchantability, fitness for a particular purpose, accuracy or non-infringement. No guarantee is made that the Software is error-free or will work uninterrupted with every machine, board or configuration.

5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, the author of the Software shall NOT be liable for any direct, indirect, incidental, special or consequential damages arising from the use of, or inability to use, the Software, including without limitation: personal injury; fire; damage to the laser machine or its components (galvo head, laser source, controller board, optics, motors); ruined parts or materials; loss of data, profits or production. Total aggregate liability shall be limited to the amount actually paid for the license in the previous 12 months (zero for the free license). Nothing herein excludes liability that cannot be excluded under mandatory law (willful misconduct or gross negligence, or non-waivable consumer rights where applicable).

6. THIRD-PARTY TRADEMARKS
EzCad and JCZ are trademarks of Beijing JCZ Technology Co., Ltd. Inkscape and any other marks mentioned belong to their respective owners and are used descriptively (compatibility) only. HagoLaser is an INDEPENDENT product: it is not affiliated with, sponsored or endorsed by those companies. The Software only READS the configuration files the user already owns in their EzCad3 installation; it does not include or distribute any JCZ third-party software.

7. DATA AND PRIVACY
For activation and usage statistics, an ANONYMOUS machine identifier (non-reversible hash), the Software version and — if you provide it — your email address (download/license) are sent to our server. Data is never sold to third parties. You may request deletion of your data via the support contact. Controller: Joyería HAGO (Spain).

8. UPDATES AND TERMINATION
We may publish updates that change or remove features. This agreement terminates automatically if you breach its terms; you must then stop using the Software. Sections 4, 5 and 6 survive termination.

9. GOVERNING LAW
This agreement is governed by the laws of Spain. Any dispute shall be brought before the courts of the author's domicile, unless mandatory law provides another forum (e.g. consumers).

10. MISCELLANEOUS
If any clause is held invalid, the remainder stays in force. This text is available in Spanish and English; in case of discrepancy the Spanish version prevails.

IMPORTANTE: LEA ATENTAMENTE ANTES DE USAR. Al instalar, activar o usar HagoLaser (el «Software») usted acepta quedar vinculado por este contrato. Si no está de acuerdo, no use el Software y desinstálelo.

1. OBJETO Y LICENCIA
El Software controla equipos de marcado/corte láser con controladora compatible. Se le concede una licencia limitada, revocable, no exclusiva e intransferible para usarlo en el equipo en el que se activó. La licencia gratuita dura 1 año (renovable sin coste). El módulo «Relieve 3D» requiere licencia de pago aparte. Queda prohibido revender, sublicenciar, descompilar o eludir el sistema de licencias, salvo en lo permitido imperativamente por la ley (p. ej. interoperabilidad, art. 6 Directiva 2009/24/CE).

2. SOFTWARE BETA
El Software se encuentra en fase BETA: puede contener errores, comportamientos inesperados o interrupciones. Usted lo acepta y asume que NO debe usarse en entornos donde un fallo pueda causar daños que no esté dispuesto a asumir.

3. SEGURIDAD LÁSER — RESPONSABILIDAD DEL USUARIO
Los láseres de fibra son equipos de CLASE 4: pueden causar ceguera, quemaduras graves e incendios en milisegundos. USTED es el único responsable de:
  a) usar SIEMPRE gafas de protección adecuadas a la longitud de onda;
  b) no dejar NUNCA la máquina marcando sin supervisión;
  c) mantener operativos los sistemas de seguridad físicos de la máquina (carcasa, interlock de puerta, parada de emergencia, extracción de humos);
  d) verificar los parámetros (potencia, pasadas, foco) antes de cada marcado;
  e) cumplir la normativa local de seguridad láser y prevención de riesgos.
El Software puede incluir funciones de ayuda (p. ej. aviso de puerta) que NO sustituyen a los sistemas de seguridad físicos de la máquina.

4. SIN GARANTÍAS («TAL CUAL / AS IS»)
EL SOFTWARE SE PROPORCIONA «TAL CUAL» Y «SEGÚN DISPONIBILIDAD», SIN GARANTÍAS DE NINGÚN TIPO, expresas o implícitas, incluidas, sin limitación, las de comerciabilidad, idoneidad para un fin particular, exactitud o no infracción. No se garantiza que el Software esté libre de errores ni que funcione sin interrupciones con todas las máquinas, placas o configuraciones.

5. LIMITACIÓN DE RESPONSABILIDAD
EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, el autor del Software NO será responsable de ningún daño directo, indirecto, incidental, especial o consecuente derivado del uso o imposibilidad de uso del Software, incluidos, sin limitación: lesiones personales; incendios; daños a la máquina láser o a sus componentes (cabezal galvo, fuente láser, placa controladora, óptica, motores); piezas o materiales estropeados; pérdida de datos, de beneficios o de producción. La responsabilidad total acumulada quedará limitada al importe efectivamente pagado por la licencia en los 12 meses anteriores (cero en el caso de la licencia gratuita). Nada de lo anterior excluye la responsabilidad que no pueda excluirse conforme a derecho imperativo (dolo o culpa grave, o los derechos irrenunciables de los consumidores donde resulten aplicables).

6. MARCAS DE TERCEROS
EzCad y JCZ son marcas de Beijing JCZ Technology Co., Ltd. Inkscape y demás marcas citadas pertenecen a sus respectivos titulares y se usan solo de forma descriptiva (compatibilidad). HagoLaser es un producto INDEPENDIENTE: no está afiliado, patrocinado ni respaldado por dichas empresas. El Software solo LEE los ficheros de configuración que el usuario ya posee en su instalación de EzCad3; no incluye ni distribuye software de terceros de JCZ.

7. DATOS Y PRIVACIDAD
Para la activación y estadísticas de uso se envía a nuestro servidor un identificador ANÓNIMO de la máquina (hash no reversible), la versión del Software y, si usted la facilita, su dirección de email (descarga/licencia). No se venden datos a terceros. Puede solicitar la eliminación de sus datos escribiendo al contacto de soporte. Responsable: Joyería HAGO (España).

8. ACTUALIZACIONES Y TERMINACIÓN
Podemos publicar actualizaciones que modifiquen o retiren funciones. Este contrato termina automáticamente si usted incumple sus términos; en tal caso deberá dejar de usar el Software. Las cláusulas 4, 5 y 6 sobreviven a la terminación.

9. LEY APLICABLE
Este contrato se rige por la legislación española. Para cualquier controversia serán competentes los juzgados y tribunales del domicilio del autor, salvo que la ley disponga imperativamente otro fuero (p. ej. consumidores).

10. VARIOS
Si alguna cláusula fuera declarada nula, el resto conservará su validez. Este texto está disponible en español e inglés; en caso de discrepancia prevalece la versión española.
